1. Introduction
These terms and conditions apply to all bookings, payments, and use of the studio facilities of Studio Boenkop. By making a booking, the client agrees to these terms.
2. Definitions
- Studio Boenkop: The lessor of the studio facilities.
- Client: The natural or legal person making a booking.
- Consumer: A natural person acting for purposes outside their business or professional activity.
- Booking: The agreement between Studio Boenkop and the client regarding the use of the studio.
- Facilities: The studio and associated spaces and equipment.
- Equipment: All technical means made available during the booking.
- Force Majeure: Circumstances beyond Studio Boenkop's control, as described in article 13.
3. Applicability
These terms apply to all services, bookings and agreements of Studio Boenkop. Deviations are only valid if agreed in writing.
4. Bookings and Age Requirements
4.1 Process
- Bookings are made via the online booking system.
- A booking only becomes final after confirmation and full payment.
- Minimum booking time is 2 hours.
- All times are in local time (CET/CEST).
4.2 Age Requirements
- Only adults (18 years or older) may make a booking.
- For use by minors, the agreement must be entered into by a parent or legal guardian.
- The parent or guardian remains at all times responsible for the behaviour of the minor and any damage.
- Minors under 16 must at all times be supervised by an adult.
4.3 Availability
- Availability is displayed as accurately as possible. Simultaneous bookings may cause a conflict.
- Studio Boenkop reserves the right to block time slots for maintenance or internal activities.
- Studio Boenkop reserves the right to refuse bookings without giving reasons.
5. Prices and Payment
5.1 Rates
- All prices include VAT unless stated otherwise.
- Rates may vary depending on time of day and day of the week.
- Discount codes are only valid under their associated conditions.
5.2 Payment
- Payment is made in advance via the available payment methods.
- In case of late or incomplete payment, the booking may be cancelled.
- For business clients, payment terms of 14 days after invoice date apply.
- In case of a failed payment after confirmation, the booking is not guaranteed. Contacting the studio is recommended.
6. Use of the Facilities
6.1 Access
- Access to the studio is only permitted during the booked period.
- Late arrival is permitted, but the end time of the booking remains unchanged.
- If the end time is exceeded, an additional fee of €25 per started half hour may be charged, exclusively if there is no next booking. The next client must not be disturbed in their activities.
- Access is obtained via the web portal: clients can press the designated button during their booking period to unlock the front door.
- The client is responsible for correctly securing access when leaving the premises. Failure to do so may result in the client being held liable for any consequential damage.
6.2 Code of Conduct
- The client must behave respectfully and responsibly.
- Smoking and vaping are not permitted in the studio.
- Eating and drinking are only permitted in designated areas.
- The number of persons present may not exceed the maximum specified at booking.
- Noise and odour nuisance to neighbours and other users is strictly prohibited.
- When the photo studio and podcast room are rented simultaneously, tenants must not disturb each other and sound levels must be adjusted accordingly.
- Alcohol consumption is permitted for adults, but not in the presence of minors.
6.3 Equipment
- Available equipment is specified when making the booking.
- The client is responsible for careful use in accordance with the instructions provided.
- Defects or damage must be reported immediately.
- Damage caused by careless or improper use will be invoiced at replacement value.
6.4 Theft and Safety
- The client is fully responsible for their personal belongings during their stay in the studio.
- Studio Boenkop cannot be held liable for theft of personal belongings, including but not limited to cameras, lenses, laptops, phones, jewellery or other valuables.
- It is strongly recommended not to leave valuables unattended, even during brief absences.
- The studio is equipped with security cameras for the protection of Studio Boenkop, its staff, clients and models. Camera footage is only consulted when irregularities are detected and is not distributed or published.
- In case of suspected theft, the client must immediately contact the local police and Studio Boenkop at administratie@boenkop.be.
- The client is advised to take out their own insurance covering theft of personal belongings outside the home.
- Taking material, equipment or accessories from the studio is at all times considered theft and will be prosecuted.
- All studio property must remain in the studio and may only be used during the booked period.
7. Environment and Cleanliness
- Waste must be separated according to the bins provided.
- The use of confetti, glue, paint or other difficult-to-remove materials is prohibited.
- In case of extreme soiling, cleaning costs of €50-200 may be charged.
- Flammable materials such as fireworks, petrol, solvents are strictly prohibited.
8. Right of Withdrawal (consumers only)
8.1 Withdrawal Period
Consumers have the right to withdraw from the agreement within 14 days of its conclusion without giving reasons. This period expires 14 days after the day the agreement was concluded.
8.2 Exercising the Right of Withdrawal
To exercise the right of withdrawal, the consumer must notify us at administratie@boenkop.be of their decision to withdraw from this agreement by means of an unambiguous statement.
8.3 Effects of Withdrawal
If the consumer withdraws from this agreement, all payments received will be reimbursed without delay and no later than 14 days after we have been informed of the decision.
8.4 Exception
The right of withdrawal expires if the service has been fully performed before the end of the withdrawal period and performance has begun with the consumer's explicit prior consent.
9. Cancellations and Changes
9.1 Cancellation by client
- Up to 7 days before start: full refund (100%).
- Less than 7 days before start: 50% refund.
- After start (booked start time) or no-show: no refund.
- Cancellations must be reported by email or via the booking system.
9.2 Changes
- Changes may be requested but are subject to availability and studio approval.
- Changes within 24 hours before start may incur administrative costs of €15.
9.3 Cancellation by Studio Boenkop
- In case of force majeure or technical failures, the booking may be cancelled by Studio Boenkop.
- In that case, the client is entitled to a full refund or an alternative time slot.
10. Liability and Insurance
10.1 Limitation of Liability
Studio Boenkop is not liable for:
- Theft, loss or damage to the client's personal belongings, regardless of their value or nature
- Theft by third parties, including other clients, visitors or unknown persons who have gained access to the premises
- Indirect or consequential damage
- Damage resulting from power or internet outages
- Damage from incorrect or incompetent use of equipment
- Physical injuries, accidents or damage to materials brought by the client
- Loss of data, photos or other files stored on personal devices
10.2 Insurance and Recovery
- The client is advised to take out their own liability insurance.
- All damage to the studio or equipment caused by the client will be recovered from the client.
- The client indemnifies Studio Boenkop against claims from third parties arising from the use of the facilities.
- The studio accepts no liability for accidents or physical injuries during use.
11. Intellectual Property
- All content on the website and in the studio remains the property of Studio Boenkop.
- It is not permitted to copy or distribute material without written consent.
12. Privacy and Data Protection
12.1 Privacy Policy
Studio Boenkop respects the privacy of its clients. Personal data is processed in accordance with our privacy policy.
12.2 Processing Purposes
Personal data is processed for:
- Processing and managing bookings and payments
- Communication about bookings
- Safety and security of the facilities
- Legal obligations
12.3 Rights of Data Subjects
Clients have the right to access, rectification, erasure, restriction of processing, portability and objection regarding their personal data. These rights can be exercised via administratie@boenkop.be.
12.4 Retention Periods
Personal data is not retained longer than necessary for the purposes for which it was collected, with a maximum of 7 years after the last booking.
12.5 CCTV
The studio is equipped with security cameras for the protection of Studio Boenkop, its staff, clients and models. Camera footage is only consulted when irregularities are detected and is not distributed or published. Images are retained in accordance with applicable privacy legislation.
13. Complaints and Dispute Resolution
13.1 Complaints
- Complaints must be submitted in writing with reasons via administratie@boenkop.be, no later than 7 days after the studio visit.
- We aim to respond to all complaints within 7 working days.
13.2 Dispute Resolution
- For disputes with consumers, we refer to the European Online Dispute Resolution Platform: https://ec.europa.eu/consumers/odr/
- We do not participate in dispute resolution procedures before a dispute resolution committee.
14. Safety and House Rules
- Emergency exits must always remain clear.
- Flammable materials are prohibited.
- Instructions from staff must be strictly followed.
- In case of an emergency, the building must be evacuated immediately.
- Serious or repeated violations of the house rules may lead to immediate termination of use without refund.

15. Force Majeure
Force majeure means: all causes from outside that Studio Boenkop cannot influence, including but not limited to power outages, internet failures, fire, water damage, government measures, pandemics or strikes. Studio Boenkop is not obliged to pay compensation in these cases.
16. Account and Login Credentials
- The client is responsible for the careful use and confidentiality of their login credentials.
- Misuse must be reported immediately.
- Accounts are personal and non-transferable.
- Studio Boenkop may block accounts in case of misuse or misconduct.
17. Image Material and Publication Rights
Unless otherwise agreed in writing:
- The client retains all rights to the image material they produce.
- Studio Boenkop makes no claim to intellectual property of client productions.
- The client is themselves responsible for obtaining permissions (such as portrait rights) from photographed persons.
- Studio Boenkop is not liable for the content of client productions.
18. Discount Codes and Promotions
- Discount codes are personal unless stated otherwise.
- They cannot be combined with other promotions.
- The validity period of discount codes is limited.
- Misuse (resale, multiple use, false identity) may lead to blocking of access.
- After a booking, the price difference is not refunded if a promotion becomes available later.
19. Changes to the Terms
Studio Boenkop reserves the right to modify these terms. The most current version is always available on the website. With a new booking, the client is deemed to agree to the terms then in force.
20. Applicable Law
Belgian law applies to these terms and conditions. Disputes are submitted to the competent court of the district where Studio Boenkop is established.
